Futuro das Polícias é discutido em Simpósio Jurídico

Temas importantes que irão definir o futuro das polícias Civil e Militar foram discutidos nesta quinta-feira (10.12) durante o I Simpósio Jurídico da Polícia Judiciária Civil, realizado no auditório da Ordem dos Advogados do Brasil (OAB-MT). O evento foi promovido pelos Sindicatos dos Delegados (Sindepo), dos Investigadores (Siagespoc) e dos Escrivães (Sindepojuc) para esclarecer dúvidas acerca de pautas nacionais como o ciclo completo de polícia e cumprimento das prerrogativas constitucionais, para uma investigação pautada na garantia dos direitos fundamentais.
O simpósio reuniu cerca de 300 participantes, entre delegados, investigadores, escrivães, advogados, estudantes, militares e lideranças comunitárias, na discussão que abordou temas de debates nacionais como  eficiência no trabalho policial, unificação das polícias, desmilitarização, modernização do sistema investigativo brasileiro, lavratura do termo circunstanciado de ocorrência (TCO), redução da criminalidade, dentre outros.
De acordo com o presidente da Associação dos Delegados de Polícia, José Lindomar Costa, são inevitáveis as mudanças no atual modelo de polícia, mas é necessário discutir para que todos entendam as propostas em nível de Brasil. “A sociedade clama por mudanças e a Polícia Judiciária Civil de Mato Grosso precisa estar  dentro desse processo para garantir não só os seus direitos conquistados, suas prerrogativas investigativas. A investigação qualificada é uma garantia dos direitos individuais do cidadão, sem essa investigação de forma cientifica qualificada, não temos condições de proteger o cidadão”, pontuou.
“A polícia judiciária é o primeiro garantidor do direito do cidadão. Ela está ali para atender 24 horas, para dizer se deve ser preso, se o flagrante deve ser feito e se deve ser colocado em liberdade. Essa é uma das grandes garantias de todo cidadão”, completou.
O delegado da Polícia Civil do Paraná, Henrique Hoffmann Monteiro de Castro, abriu o simpósio com o tema “Investigação criminal qualificada como garantia dos direitos individuais”. Especialista em Direito Penal e Processual, professor e autor de vários artigos jurídicos, Hoffmann destacou a realização do simpósio como iniciativa excepcional, principalmente, ao trazer para o debate assuntos polêmicos como a viabilidade do ciclo completo de polícia.
“Pude expor posições das nossas cortes superiores, do STJ e de organismos nacionais e internacionais dos Direitos Humanos, no sentido de que não deve ser militarizado o sistema de investigação e tratamos aqui também de pontos essenciais como o fato da polícia judiciária ser um órgão imparcial, que atua na persecução penal, assim como o Poder Judiciário”, defendeu.
Hoffmann disse que espera que todos os comandos constitucionais sejam cumpridos, para que a polícia atue de forma imparcial, sempre respeitando os direitos das partes  envolvidos, seja vítima ou investigado. “E que além de ser cumprido o ordenamento jurídico, que o estado invista adequadamente na polícia, a gente não pode discutir efetividade de investigações com  o estado se omitindo no seu dever de aparelhar, de instrumentalizar a polícia, para que tenha condições de investigar”, ressaltou.
A palestra teve como mediadora a delegada e diretora de Inteligência da Polícia Civil, Alana Derlene Cardoso, e debatedores, o secretário geral da OAB-MT, Ulisses Rabaneda, e o delegado Luiz Henrique Damasceno.
O advogado Ulisses Rabaneda disse que foi gratificante para a OAB ter em sua casa discussão de tamanha importância, que envolve a polícia, os advogados e o parlamento. Segundo ele, a presença do advogado no inquérito policial garante legitimação a investigação e neste ponto destacou o trabalho dos delegados plantonistas que têm cumprido com todas as prerrogativas dos advogados. “Os maiores índices de erros no Judiciário se dá em ambiente de confissões. A resistência do investigado não deve ser vista como algo que irá atrapalhar a investigação”, disse.
O juiz de direito do Rio de Janeiro André Luiz Nicolitt foi segundo palestrante do simpósio e falou sobre a “Polícia Judiciária Civil como órgão de Defesa do Estado Democrático de Direito”. Nicolitt é professor de processo penal, jurista, escritor e tem doutorado pela Universidade Católica Portuguesa, em Lisboa.
O jurista, em sua apresentação, destacou a usurpação de funções como algo extremamente deletério para o estado democrático de direito, uma vez que está  sistematizado a competência de cada órgão, seja do sistema de Justiça, seja do sistema de polícia. “Acho que a principal mensagem para esse evento é a relevância da Polícia Judiciária como um órgão fundamental para construção de um estado democrático de direito, seja com respeito à legalidade, uma investigação pautada na garantia dos direitos fundamentais e nesse cenário é fundamental uma noção bem precisa sobre a atribuição porque em todos os órgãos do estado, diante de certa onda autoritária vem ocorrendo uma promiscuidade nas funções”, disse.
O presidente do Sindicato dos Investigadores também defendeu a necessidade de fortalecer a polícia para o combate à criminalidade. “A prova maior é que o crime hoje se organiza cada vez mais no Brasil, enquanto as policiais discutem que caminho vai   tomar futuramente. E por isso que estamos aqui. Acho temos que fazer essa reflexão e cobra dos poderes, principalmente do executivo, para promovermos as mudanças necessárias  e que tenhamos uma segurança forte, tanto a nível estadual quanto a nível federal”, disse.
Para a presidente do Sindicato dos Escrivães de Polícia, Genima da Silva Almeida Evangelista, há muitas dúvidas no meio policial e também no seio da sociedade sobre as propostas de mudanças das policiais, como o modelo do ciclo completo de polícia que vem sendo discutido. “Nos sabemos que a Segurança Pública hoje, não só em Mato Grosso, mas em todo país, necessita de urgentes mudanças, mas precisamos que essas mudanças partam das pessoas que conhecem a realidade da polícia e não de pessoas que querem apenas opinar e não conhecem a nossa estrutura, nossa realidade, nosso papel”, declarou.
O advogado Waldir Caldas que atuou como debatedor na palestra do juiz André Nicolitt também disse que a discussão é necessária para aprimorar o modelo de polícia que a sociedade necessita. “Com iniciativas como essa efetivamente estaremos aprimorando aquilo que precisa. A OAB é parceira”, disse.
O delegado Wagner Bassi Junior atuou como mediador na palestra do jurista André e contou com auxílio do defensor público, Diogo Madrid Horita, também como debatedor.
