1. Trata-se de Recurso Extraordinário interposto em face de acórdão do Colégio Recursal do Juizado Especial Cível de Diadema/SP, que, por entender constitucional o art. 28 da Lei 11.343/2006, manteve a condenação do recorrente pelo crime de porte de drogas para o consumo pessoal.
2. Alega o recorrente que “o crime (ou a infração) previsto no artigo 28 da Lei 11.343/2006 ofende o princípio da intimidade e vida privada, direito expressamente previsto no artigo 5º, X, da Constituição Federal e, por conseguinte, o princípio da lesividade, valor basilar do direito penal”. Sustenta, em síntese, que “à conduta de portar drogas para uso próprio falta a necessária lesividade. Deveras, o comportamento tido pelo legislador ordinário como criminoso retrata apenas o exercício legítimo da autonomia privada, resguardada constitucionalmente pelo direito à vida íntima. O porte de drogas para uso próprio não afronta a chamada “saúde pública” (objeto jurídico do delito de tráfico de drogas), mas apenas, e quando muito, a saúde pessoal do próprio usuário”.
3. A Instituição Viva Rio, a Comissão Brasileira Sobre Drogas e Democracia (CBDD), Associação Brasileira de Estudos Sociais do Uso de Psicoativos (ABESUP), o Instituto Brasileiro de Ciências Criminais (IBCCRIM), o Instituto de Defesa do Direito de Defesa (IDDD), a Conectas Direitos Humanos, o Instituto Sou da Paz, o Instituto Terra, Trabalho e Cidadania (ITTC), a Pastoral Carcerária e a Associação dos Delegados de Polícia do Brasil (ADEPOL/BR), foram admitidas no processo na condição de amici curiae.
4. O Tribunal reconheceu a existência de repercussão geral da questão constitucional suscitada.
