Senador Ricardo Ferraço (PMDB-ES) critica presunção de inocência

O senador Ricardo Ferraço (PMDB-ES) criticou nesta quinta-feira (1º/10) a presunção plena de inocência ao comentar o Projeto de Lei do Senado 402/2015, que altera o Código de Processo Penal para autorizar a decretação de prisão para crimes graves a partir de decisão de colegiado de segundo grau.

Para ele, a cultura da presunção plena da inocência é uma espécie de “jabuticaba”, assim como a possibilidade de recursos consagrando o duplo grau de jurisdição. “Mas, em nosso país, esse grau não é duplo, esse grau se eleva à quarta potência porque esses recursos vão ainda aos tribunais superiores, e essa procrastinação, essa indústria de recursos ofende profundamente a população brasileira pela percepção de impunidade que cria.”

Na opinião do advogado Antonio Carlos de Almeida Castro, o Kakay, a presunção de inocência é uma garantia constitucional do processo penal brasileiro, sendo um “retrocesso” a sua eliminação. “A pena de prisão deve ser aplicada quando absolutamente necessária”, disse, lembrando a possibilidade da adoção de medidas cautelares diversas da prisão. Ele alerta para o risco do aumento da população carcerária, caso o projeto seja aprovado, e cita as condições precárias dos presídios brasileiros.

Ferraço é relator da proposta, elaborada pela Associação dos Juízes Federais do Brasil, na Comissão de Constituição, Justiça e Cidadania. Para a entidade, não é razoável transformar a sentença condenatória ou o acórdão condenatório, ainda que sujeitos a recursos, em um “nada” jurídico, como se não representassem qualquer alteração na situação jurídica do acusado.

O PLS revoga ainda o parágrafo 4º no artigo 600 do Código de Processo Penal, que permite ao apelante apresentar suas razões de apelação diretamente na instância recursal, reduz o cabimento dos embargos infringentes e possibilita a imposição de multa pela interposição de embargos de declaração protelatórios.
